Terms of Service

1. The Service

AnswerlyOS lets agencies deploy and manage AI voice receptionists for their own clients under the agency's brand, including phone numbers, call handling, a client console and portal, CRM, and billing tools. We may update, add, or remove features over time.

2. Accounts and eligibility

You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 18 and use the Service for business purposes.

3. Agency and client responsibilities

Agencies resell the Service to their own clients and are responsible for those clients and end users, including obtaining all required consents for calls, recordings, text messages, and outreach. You are responsible for complying with all applicable laws, including telemarketing, call recording, robocalling, and consumer protection laws such as the TCPA and equivalent rules in your jurisdiction. You will not use the Service for unsolicited bulk calling or messaging.

4. Acceptable use

You agree not to use the Service to:

• Break the law or violate the rights of others.
• Send spam, conduct fraud, or place unlawful or deceptive calls.
• Handle content or activity you are not authorized to handle.
• Interfere with, reverse engineer, or attempt to disrupt the Service.
• Resell the Service except as expressly permitted as an agency.

5. Fees and billing

Paid plans include a recurring subscription and may include usage-based charges, such as minutes beyond your plan's included amount. Fees are billed through our payment processor. You authorize us to charge your payment method for all fees and applicable taxes. Unless required by law, fees are non-refundable. We may change pricing on reasonable notice, effective at your next billing period.

6. Your content and data

You and your clients retain ownership of the data and content you put into the Service. You grant us a limited license to host, process, and transmit that content as needed to provide the Service. Our handling of personal information is described in our Privacy Policy.

7. Intellectual property

The Service, including its software, design, and brand, is owned by JavlinAI and its licensors. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service under these Terms.

8. Third-party services

The Service relies on third-party providers for hosting, telephony, AI, and payments. Your use of those features may be subject to the providers' terms, and we are not responsible for third-party services.

9. AI output disclaimer

The Service uses AI to handle calls and generate transcripts and summaries. AI can make mistakes and may produce inaccurate or incomplete output. You are responsible for reviewing output and for any decisions made based on it.

10. Warranty disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, JavlinAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the three months before the claim.

12. Indemnification

You will defend and indemnify JavlinAI from claims arising out of your use of the Service, your content, your clients and end users, or your violation of these Terms or applicable law.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms, non-payment, or to protect the Service. On termination, your right to use the Service ends and we may delete your data after a reasonable period.

14. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. The state and federal courts located in New York will have exclusive jurisdiction over any dispute, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the date above. Continued use after changes take effect means you accept the updated Terms.
